Late filing of income tax return in Pakistan: penalty and ATL surcharge, deadline 15 October 2026

Last updated: 10 October 2026

The deadline for filing your Tax Year 2026 income tax return has been extended to 15 October 2026 for persons who were required to file by 30 September. If you miss it, filing late is still better than not filing at all, but it is now much more expensive than before. This guide explains what late filing costs in Pakistan and what you can do about it.

If you have not started yet, read our step-by-step guide to filing your income tax return in Pakistan first. There is still time.

What happens if you file your income tax return late?

Late filing can lead to three separate consequences. They are different charges, and you can face more than one of them.

1. Penalty under Section 182

The Income Tax Ordinance allows a penalty for failing to file a return by the due date. The amount depends on your income, the tax payable and how many days you are late, and it is higher for non-salaried taxpayers than for salaried individuals. Because the exact amount depends on your case, check FBR’s current rules or ask a tax advisor before assuming a figure.

2. ATL surcharge under Section 182A

A late filer is added to the Active Taxpayer List (ATL) only after paying a surcharge. Under the Finance Act 2026, effective 1 July 2026, this surcharge increased sharply:

TaxpayerEarlier surchargeSurcharge from 1 July 2026
IndividualRs 1,000Rs 25,000
Association of persons (AOP)Rs 10,000Rs 50,000
CompanyRs 20,000Rs 100,000

For many salaried people and small business owners, this single charge is far larger than the cost of filing on time.

3. Higher withholding tax as a non-filer

If you are not on the ATL, banks, property offices and vehicle registration offices apply higher withholding tax rates to your transactions. News reports say that from 1 October 2026 the separate “late filer” category is being discontinued, so a person who has not filed by the deadline is treated as a non-filer. Please confirm the current position on fbr.gov.pk, as FBR notifications can change.

A possible relief: ATL without the surcharge (proposal only)

On 6 October 2026, FBR issued a draft amendment to the Income Tax Rules proposing that an individual who files late could join the ATL without paying the surcharge by submitting an undertaking (Form ATL-U) in IRIS. Reports say the undertaking would commit the person not to acquire any property for six months. This is only a draft open for objections and suggestions. It is not final, so do not plan around it until FBR notifies the final rule.

What should you do now?

  1. If the deadline has not passed (before 15 October 2026): file your return now. You avoid the penalty and the surcharge, and you stay on the ATL.
  2. If you have missed the deadline: still file as soon as possible. Every extra day can increase the penalty, and you cannot get back on the ATL until you have filed.
  3. Check your status after filing with our guide to checking your ATL status in Pakistan.
  4. Keep your records: the IRIS acknowledgement, the PSID and the payment receipt for any penalty or surcharge.
